A Nigerian lawmaker, precisely in the Edo State House of
Assembly, who took to armed robbery and thuggery has been arrested by the
Nigerian Police, and arraigned in court early this year.
The state legislator, whose name was given as Rasak Momoh,
hails from Auchi, Etsako West Local Government Area of Edo State, Nigeria.
Early June,2013,Rasak Momoh was standing trial at High Court 1,sitting in
Auchi,for illegal possession of fire arms, and alleged robbery.
He was arrested at Baladi Hotel, Aviele in Etsako West Local
Government Area on April 20, the day the state held its council polls.Momoh had
earlier been arraigned before Magistrate Caroline Nwoha,in Auchi.Mrs. Nwoha had
ordered that the case file be sent to the Director of Public Prosecutions, and
that the accused be remanded in Auchi Medium Prison, pending hearing on June 3.
However,the court could not hear the case on the adjourned
date as Magistrate Nwoha declined to entertin the suit for lack of jurisdiction.Therefore,the
case was subsequently transferred to the
high court.Hearing the case on Friday June 21,Justice Ada Ehigiamosoe,granted bail to the suspect, in the sum of 1million Naira, with two sureties
who must have landed properties and resident in Auchi,Etsako West Local
Government Area.
The prosecutor, commissioner of police, urged the court to
refuse bail to the accused, alleging that he is influential and for that reason
would jump bail.
But,Justice Ehigiamusoe said that the accused had provided
sufficient facts to be granted bail. He said; ‘the fact that the accused is
popular does not mean he will jump bail when granted.’’
With the granting of bail, the prosecutor is expected to
provide a trial date.
